ACCOMMODATION SALES AGREEMENT
ARTICLE 1: PARTIES
One party is Ford Hotel, located at Sahil Cad. No 220 Adrasan / ANTALYA, and the other party is .......... (hereinafter referred to as the Consumer). They have reached a full agreement on the matters specified below.
ARTICLE 2: SUBJECT
This agreement includes the Consumer's hotel (facility) reservation through Ford Hotel and the associated hotel accommodation sales conditions under the terms specified below.
ARTICLE 3: IMPLEMENTATION
3/A - Accommodation will take place between .............. and ............... (a total of ...... nights). The names of the persons staying are ..........
3/B - The Consumer will stay at the facility named ................., in a ................. room type, with a ................. meal plan.
3/C - The Consumer's check-in time at the hotel is 14:00. The latest check-out time from the hotel is 12:00.
3/D - The Consumer has the right to withdraw from the service within 7 days from the reservation or contract signing date, without any legal or penal responsibility and without providing any justification. Early reservation - New Year's Eve - Holiday - Semester, etc., promotional period products are excluded from this article.
3/E - The Consumer agrees to comply with the rules notified by Tau Tatil, the Facility officials, and Guides regarding the purchased service, to respect the life, property security, and peace of third parties, and acknowledges that if these are not followed, they will not receive the service, and in such cases, they do not have the right to a refund.
3/F - Ford Hotel is not responsible for force majeure events that occur after the start of the service specified in the contract, situations arising from the Consumer, and the personal responsibilities of third parties. In cases within its responsibility, Ford Hotel may compensate for the changes that are unfavorable to the Consumer either by refunding the price or service according to the TÜRSAB Kütahya Chart regulations or by offering additional and/or alternative arrangements that are not included in the price and are provided to the Consumer during the service. If the Consumer has used or consumed these additional or replacement services, it eliminates their rights to a refund and compensation.
3/G - In case of any loss of luggage, valuables, and similar items at the facility where the Consumer is staying, if the Consumer informs Tau Tatil by having the necessary reports drawn up by the relevant law enforcement authorities, Tau Tatil will inform the Facility. Ford Hotel cannot be held responsible for such situations.
ARTICLE 4: DURATION AND TERMINATION
4/A - The Consumer may cancel the purchased product or transfer it to another person or persons, provided it is suitable for the same reservation type, except for early reservation discounted products, within a maximum of 7 days from the reservation date. The transferee is jointly responsible with the transferor for any remaining balance and all costs incurred due to the transfer. The Consumer is obliged to submit all cancellation/transfer requests to Ford Hotel in writing within the specified period. If the purchased service is a promotional product and/or there are fewer than 7 days between the reservation and the start of the accommodation, this article does not apply.
4/B - If the Consumer requests cancellation, change, or transfer between 8 and 15 days from the reservation date, 5% of the accommodation fee specified in the contract will be deducted as a withdrawal compensation. No refunds are made for promotional products such as early reservation - New Year's Eve - Holiday - Semester, etc. If the Consumer requests cancellation, change, or transfer from the 16th day after the reservation date, this request will not be accepted, and the paid fee will not be refunded.
4/C - If the Consumer does not notify in writing that they will participate in the service they missed the start of, Ford Hotel has the right to cancel all reservations and services made in the Consumer's name 24 hours after the start date of the service. In such cancellations, no fee will be refunded to the Consumer.
4/D - If the Consumer or their first-degree relatives have habitual occupations hindering illnesses coinciding with the accommodation period, documented by an official report from a fully equipped state hospital, or in the event of death, the reservation cancellation request will be accepted, and the reservation fee will be refunded. In this case, the report and documents must be submitted before the start of the service. If this situation occurs during the continuation of the accommodation service, the excuse must be submitted to Ford Hotel along with the document within a maximum of 1 day from the date of departure from the Facility.
4/E - Ford Hotel may partially or completely change or cancel the announced or registered hotel reservation by notifying the Consumer, 7 days before the start date of the service, or 1 day in advance during special days and/or periods. If the Consumer does not accept these changes and cancellations, they have the right to cancel the reservation and receive a full refund of the paid fee. In this case, the Consumer does not have any right to compensation.
ARTICLE 5: CANCELLATION AND OTHER PROVISIONS
5/A - It is the duty of a well-intentioned Consumer to notify the Facility and the Ford Hotel representative in writing during the execution of the service of any complaints and early departure requests from the Facility. The Consumer is obliged to notify the Ford Hotel representative and the Facility in writing of the reasons for terminating the service. If the Consumer uses the service until the end without notifying the Ford Hotel representatives or leaves the Facility early, it eliminates their rights to replacement service, refund, and other compensation.
5/B - If desired, the Consumer can insure the return costs to the departure point and any damages and treatment costs arising from any accident, at their own expense, before the accommodation service starts. The scope of coverage related to the damages, losses, and liabilities of the travel insurance purchased by the consumers is determined by the policy of the insurance company providing this service. Ford Hotel is not responsible for the content, scope, or application forms of these coverages.
5/C - Even if the Consumer has not signed this contract for any reason, by making the payment related to this reservation via mail order, virtual POS, transfer, or EFT, these contract terms will be valid between the parties. In this case, the Consumer acknowledges that they have learned the contract terms from the catalog, website, or advertisements and will receive the services specified in the contract under these written terms.
5/D - The Consumer declares that they have signed this reservation contract after obtaining all the information about the Facility mentioned in the contract from the web addresses of Ford Hotel and/or Ford Hotel sales representatives and after conducting and reading the necessary examinations.
5/E - Ford Hotel has announced the qualifications, star rating, and services provided by the reserved Facility based on the Facility's declarations, brochures, and the information on the Facility's official website. In cases where the Facility does not meet the advertised features and star standards, the responsibility lies exclusively with the Facility. If the Facility does not meet the promised standards or is not in a position to provide service at these standards on the accommodation start date, Ford Hotel may offer the Consumer to stay at a Facility of the same or higher category. If the Consumer does not accept such a change, they have the right to a full refund of the total payment made for the reservation.
5/F - Identity and age checks are conducted upon entry to the Facility. If there is a discrepancy due to incorrect or incomplete declarations, the difference will be collected at the time of entry to the Facility.
5/G - The periods specified in articles (4-A and 4-B) of this contract do not apply to reservations covering the early booking period; cancellations, changes, and transfers related to this period are only applicable to consumers with cancellation insurance.
5/H - At least 5% of the accommodation fee must be paid at the time of reservation, and the balance must be paid no later than 15 days before the start of the service. If there are fewer than 15 days between the reservation and the start date of the service, the full accommodation fee is collected. If the specified payments are not made within the stated period, the reservation will be canceled, and 5% of the accommodation fee will be charged to the Consumer as withdrawal compensation. Consumers who purchase discounted/special products or promotional products are required to pay the full service fee at the time of reservation. If the purchased service is an early reservation or another promotional product, the Consumer is responsible for the full accommodation fee as withdrawal compensation if the balance payment is not made on time.
5/I - For price increases for early booking periods and/or all periods (excluding system errors), the difference will not be requested from the Consumer, nor will the discount described as an action by the Facility be refunded to the Consumer.
5/J - The Consumer acknowledges and declares that they consent to the newsletters sent by Ford Hotel and its websites for campaign announcement purposes to the e-mail, mobile phone, fax, etc., information provided to Ford Hotel employees and/or websites during the reservation process.
ARTICLE 6: CONTRACT FEE AND PAYMENT
6/A - The contract fee is ................. TL, including VAT.
6/B - The Consumer accepts and declares that with this contract, they authorize Ford Hotel to collect the price of the goods and services received and/or to be received.

6.D - Pursuant to the relevant provisions of the Tax Procedure Law, the invoice to be issued in return for the service received will be collected from Ford Hotel within 7 days following the end of the service.
6.E - This protocol has been drawn up and signed on 01.02.2016, and in disputes arising from the protocol, the TÜRSAB KÜTAHYA CHART and the relevant legislative provisions will apply exclusively. Antalya Courts have jurisdiction over disputes arising from this contract.
